The Problem of Abusiveness of Consumer Credit Costs (Excluding Interests) not Exceeding Legal Limit from art. 36a KredytKonsU
Streszczenie:
W 2015 r. ustawodawca dodał art. 36a do KredytKonsU, który wprowadził sztywne ograniczenia maksymalnych kosztów pozaodsetkowych kredytu konsumenckiego. Regulacja poskutkowała rozbieżnościami w orzecznictwie sądów. Przed sądami pojawił się praktyczny problem, czy klauzule regulujące wysokość pozaodsetkowych kosztów mogą być badane pod kątem abuzywności na gruncie art. 3851 k.c. wówczas, gdy nie przekraczają ustawowego limitu. Sąd Najwyższy dotychczas nie badał powyższego problemu prawnego.

Abstract:
In 2015 the Polish legislature added Article 36a to KredytKonsU, setting the maximal height of consumer credit costs (excluding interests). This regulation resulted in discrepancy of courts’ opinions. Courts were faced with a practical problem of admissibility of analysing the abusiveness of clauses determining the height of credit costs excluding interests if the said costs did not exceed the aforementioned limit. To this date, the Polish Supreme Court has not deliberated this legal problem.
